Terms of Service and Privacy Policy

Thank you for using Valdez Market! These Terms of Service govern your use of the Valdez Market services, including Valdez Market’s website, valdezmarket.com. This Agreement applies to all visitors, users, and others who access the Services.

By using the Services, you agree to these Terms and agree to the collection, use and disclosure of your personal information in accordance with Valdez Market’s Privacy Policy.

When you use the Services to place an order for goods, you authorize the purchase of those goods from Valdez market including, any separate Valdez Market fees, and your card will be charged for the goods purchased by you and any applicable fees, taxes and/or tips. You also authorize that your credit card information can be saved with your Valdez Market profile for future orders.

Valdez Market may change the fees it charges for the Services, including but not limited to delivery fees, service fees, and heavy order fees. Valdez Market will also adjust charges when rectifying products projected cost once the actual value is known.

Unless otherwise indicated, all prices and other amounts are in the currency of the jurisdiction where the delivery takes place.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions that may relate to pricing, product descriptions, promotional offers, and product availability. Valdez Market reserves the right to correct any errors, inaccuracies or omissions and to change or update information or refuse or cancel orders if any information on the Services is inaccurate at any time without prior notice (including after you have submitted your order and/or your credit card has been charged).

On the occasion the weather and road closures may not permit delivery, Valdez Market may not be able to make the delivery until the weather, or roads become safe for travel. Other reasons for delayed delivery include a sick driver, road closure, collision, avalanche, flood, and any other reason to jeopardize the safety of the Valdez Market employees or its contractors. If the food is not able to be delivered a refund will be issued within 30 days of order.

Free delivery only applies to orders over $250. If the order is below $250 the delivery fee prices may vary. Valdez Market reserves the right to change these terms and adjust the delivery fee as needed. The delivery fee of $25 is added to any order of $249 or less.

If the order has been submitted to our supplier, it cannot be canceled or refunded. If a refund is requested, it will be denied as the cost of product has already been filled. A 72-hour notice is required to obtain a refund from the Valdez Market only when the order hasn’t been submitted to a vendor.

Any cancelation requests are to be submitted to the VALDEZMARKET@GMAIL.COM and subject to review. If less than 72 hours’ notice is given before the pending delivery, the request is automatically denied. The order will be delivered as originally requested. Cancelation may still be denied if any orders have been submitted to third-party suppliers. Contacting for cancelation request is still permitted but may be denied.
1. Using Our Services

If you are using Valdez Market Services for its intended purposes on behalf of a business or other entity, you represent and warrant that you have the necessary authority to bind that business or entity to these Terms and that you are agreeing to these Terms on behalf of that business or entity.

In order to use the Services, you may need to create a user account. You agree that you are responsible for all conduct and transactions that take place on. or using your account and that you will take precautions to keep your password and other account information secure. You also agree that you will comply with all applicable laws when accessing or using the Services and you will respect those who you encounter in your use of the Services, Valdez Market personnel, including individuals who support Valdez Market’s Help Center. Valdez Market reserves the right to decline orders, refuse partial or full delivery, terminate accounts, and/or cancel orders at any time in its sole discretion.

We’re constantly modifying and improving the Services. Valdez Market may introduce new features, change existing features, or remove features from the Services at any time and without notice. If you provide Valdez Market with any feedback on or comments regarding the Services, you grant Valdez Market the right to use such feedback or comments for any purpose without restriction or payment to you.

2. Valdez Market Communications

By creating a Valdez Market user account, you agree to accept and receive communications from Valdez Market, including via email, text message, calls, and push notifications to the cellular telephone number you provided to Valdez Market. You understand and agree that you may receive communications generated by automatic telephone dialing systems and/or which will deliver prerecorded messages sent by or on behalf of Valdez Market, its affiliated companies and/or Third-Party Providers, including but not limited to communications concerning orders placed through your account on the Services. Message and data rates may apply.

3. Third-party Products and Content

When you purchase products from Valdez Market we do not recognize any discount’s or agreements that you have made directly with our supplier. The listed price and service fee provided by Valdez Market do not change based on 3rd party vendors agreements, promotions, or discounts.

4. SERVICE PROVIDED AS-IS AND RELEASE OF CLAIMS

Valdez Market makes no guarantee and is not responsible regarding warranty, conditions, timeliness, quality, suitability, availability, or any services provided by a third-party provider or vender. If any adverse effects, liabilities, injuries, illness, or damage occurs from a product, Valdez Market claims no liability in terms of acts or omissions. Any risk of using third party providers resides with you. Items listed in or any website, application, advertisement are subject to be changed without notice, and will be updated periodically, without regards to the risk you take as a purchaser. Errors may occur on the website, app, advertisements or any other Valdez Market platform and Valdez Market makes no guarantee that safety of electronics is guaranteed, including viruses or malware. You use electrics to order at your own risk and economic cost. If a dispute with one or more third-party providers arises you release Valdez Market from any liability.

These exclusions may vary depending on the law of each state. Alaska Laws preside.

5. LIMITATION OF LIABILITY

Valdez Market is a direct delivery service from a 3rd party supplier, as such does not guarantee or take responsibility for product quality, or functionality. Valdez Market receives all products from our vendor in good faith that they meet all guidelines, regulations and quality control standards and does not guarantee, warranty, or accept responsibility for any product that does not meet those standards.

6. Disputes & Arbitration

Before initiating proceedings against Valdez Market, you agree to contact Valdez Market first and attempt to work out any such dispute amicably. You agree that in the event we are not able to resolve a dispute, it will be resolved by means of arbitration, rather than in court.

7. Termination

You are able to stop using Valdez Markets services at any time. Valdez Market also reserves the right to deny service to any individual, household, or business as it sees fit.

8. Changes to the Terms

We may make changes to these Terms from time to time. When Valdez Market does so, Valdez Market will post the most current version of the Terms on Valdez Market’s website and, if a revision to the Terms is material, Valdez Market will notify you of the new Terms (for example, by email or a notification on the Services). Changes to these terms will not apply retroactively. If you do not agree to the modified terms, you should discontinue your use of the Services.
